General Terms and Conditions Lammertink Parfumerie B.V.

Article 1 – General

Article 2 – Applicability

• These General Terms and Conditions apply to all offers, agreements, deliveries and transactions by or with Lammertink Parfumerie.
• By placing an order, the consumer agrees to the General Terms and Conditions of Lammertink Parfumerie.
• Deviations from these Terms and Conditions are only valid if agreed in writing.

Article 3 – Prices

• The price for all products is stated in euros (€) including VAT. Payment costs and delivery costs are charged separately, in addition to the price of the product, and are stated during the ordering process.
• Lammertink Parfumerie is free to change its prices, payment costs and delivery costs at any time. Such changes do not affect orders that have already been confirmed by Lammertink Parfumerie in accordance with Article 4.1.

Article 4 – Agreement 

• Lammertink Parfumerie has the right to refuse one or more orders for one or more products from the consumer. The agreement with Lammertink Parfumerie regarding an ordered product is only concluded when Lammertink Parfumerie has sent an order confirmation for that ordered product to the consumer by email.
• This order confirmation also serves as the invoice for the ordered product.

Article 5 – Delivery

• Delivery takes place by delivering the ordered product to the delivery address specified by the consumer. Lammertink Parfumerie only delivers ordered products in the Netherlands and Belgium.
• The delivery period is thirty (30) days after dispatch of the order confirmation, except in cases of force majeure in accordance with Article 6.1. This is not a strict deadline.

Article 6 – Force majeure

• Force majeure within the meaning of this article is understood to mean: circumstances that prevent the (timely) fulfilment of the agreement and that cannot be attributed to Lammertink Parfumerie. This includes, but is not limited to: changes in legislation and regulations, pandemics, government measures, staff illness, storms and natural disasters, floods, fire, explosions, war, threat of war, civil war, public disturbances, strikes, disruptions in telecommunications or internet connections and cybercrime, all of which occur at Lammertink Parfumerie or its suppliers.
• If Lammertink Parfumerie is prevented by force majeure from fulfilling its obligations under the agreement, Lammertink Parfumerie has the right, without judicial intervention, to either suspend the execution of the agreement, adapt the agreement to the circumstances, or terminate the agreement in whole or in part.
• Parfumerie Lammertink is not liable to the consumer for damages due to delay in the performance of the agreement or non-performance of the agreement.

Article 7 – Right of withdrawal 

• The consumer has the right to withdraw from the agreement within fourteen (14) days of receiving the product, through webshop@parfumerielammertink.nl.
• The consumer must return the product to Lammertink Parfumerie within fourteen (14) days of invoking the right of withdrawal. The consumer shall bear the costs of returning the product.
• Consumers may only exercise their right of withdrawal if the product is returned complete, undamaged and in its original packaging.
• Lammertink Parfumerie will refund the purchase price within fourteen (14) days of receiving the returned product in accordance with Article 7.3.

Article 8 – Liability

• The consumer must use the product for its intended purpose and in accordance with the manufacturer’s instructions for use. Lammertink Parfumerie is not liable for damage resulting from incorrect use of the product.
• In cases where Lammertink Parfumerie can nevertheless be held liable, Lammertink Parfumerie’s liability shall at all times be limited to the amount paid out to it by its liability insurance, but never higher than the total amount paid by the consumer to Lammertink Parfumerie for the product.

Article 9 – Warranty 

• The warranty is governed by the applicable law.
• The consumer must notify Lammertink Parfumerie within two (2) months of the defect being discovered or reasonably ought to have been discovered.
• The consumer’s right of action in respect of a defect shall lapse two (2) years after the notification referred to in Article 9.2.

Article 10 – Privacy and data processing

• Lammertink Parfumerie processes personal data in accordance with its privacy policy.

Article 11 – Complaints procedure

• Complaints can be submitted through webshop@parfumerielammertink.nl.
• Lammertink Parfumerie will respond to a complaint within fourteen (14) days.

Article 12 – Disputes

• The agreement between Lammertink Parfumerie and the consumer is governed exclusively by Dutch law.
• Disputes will be submitted to the competent court in the Netherlands.
•  

Article 13 – Final provisions

• If any provision in these General Terms and Conditions proves to be invalid, the remaining provisions will remain in full force.
• Lammertink Parfumerie may amend these General Terms and Conditions. The current version is always available on the website.
